Diana C. Krause joins our "Bad Check Writers' Hall of Fame"!

Background:  in the summer of 2008, Diana C. Krause of Yorba Linda, California and her daughter, Heidi Krause-Nasraoui, visited my booth at the Sawdust Art Festival in Laguna Beach.  They bought two pendants.

Not too long after, Diana emailed me, requesting that I make her some custom earrings to match her pendant.  I made 3 or 4 pairs of custom earrings, photographed them, and posted them on a webpage for her viewing. I emailed Diana Krause a link to the webpage.  The price of the earrings, including tax, was $30.31.  I normally charge $5 for shipping, but I opted to discount her shipping down to $2, bringing the total to $32.31. Hi Diana... with tax, the earrings are $30.31.  For shipping, I usually charge $5 as the minimum, but for these, I think $2 is enough.  They'll go out inside a small box in a bubble mailer.  So that brings it to $32.31.

Once Diana selected a pair of the custom earrings, I asked her to send a check to my post office box, where I receive all my business mail.  This mailing address is noted on my business card and on my website's "contact" page.  Nevertheless, Diana Krause for some unknown reason sent the check to the wrong address -- an address where my studio is located -- where 40+ artists receive their mail.

Diana Krause's check was dated 9-2-08.  By the time the errant check was located, some six or seven weeks later, Diana had closed her checking account, so her check for $32.31 bounced, and Wells Fargo Bank charged my account an additional $7 service fee for the bad check.

I contacted Diana Krause via email, advising her of the bad check.  She was unable to provide a reason as to why she sent the check to the incorrect address, but nevertheless did not believe it was her fault that the check bounced!  Usually, when one closes an account, you make sure all the outstanding checks have cleared before you close it.  I asked Diana Krause to reimburse me for both the $32.31 AND the $7 bank fee, and she refused.  Check out her response here:

I will send a check for $32.31 which was the original amount charged for the earrings.  The check was sent to you the first part of September.  You didn't take it to your bank until mid November.  I am not responsible for the fact that you didn't cash it in a timely manner.  My account was not closed until Nov. 20

Let's remember that the reason I didn't take it to the "bank until mid November" and that I "didn't cash it in a timely manner" was because Diana sent the check to the WRONG ADDRESS!!  Sent to the wrong address despite instructions to do otherwise...

Diana Krause then sent me a check for $32.31, with no reimbursement for the $7 service fee on her earlier bounced check.  I never deposited it, because my concern was that she'd close that account too, or otherwise have insufficient funds for that one to clear.  Between working with her on her special-order earrings, creating 3 or 4 pairs of earring options, photographing them, photo-editing them, creating and posting them on a webpage, and all the assorted follow-up emails back and forth with her, I have already wasted too much time w/ this woman. 

I am lucky though, in that for the eight years I've run this business, Diana C. Krause's bad check was the first one I've received to date!  But this saga is just another case of people not taking responsibility for their actions.  I've always treated my clients with kindness and respect, so it was an unpleasant surprise to have this happen.
